General Privacy Policy for the Use of the App "BegleitFix"

1. General

  1. These General Privacy Policy govern the use of the app BegleitFix offered by BegleitFix GmbH (hereinafter referred to as the "Operator").
  2. By registering and using the app, users agree to this Privacy Policy.
  3. The app serves as a platform connecting providers of heavy transport escort services (hereinafter referred to as "Escort Drivers") with customers who require such services (hereinafter referred to as "Customers").

2. Services of the App

  1. The app provides a platform where Escort Drivers can offer their services, and Customers can book these services. Customers can also publicly post their needs in the app, allowing Escort Drivers to book these assignments.
  2. The Operator of the app is neither a provider nor a mediator of heavy transport escort services. The Operator is solely a technical service provider offering the platform.
  3. The Operator assumes no responsibility for the quality, safety, or execution of the offered services.

3. Registration and User Account

  1. The use of the app requires users (Customers or Escort Drivers) to register.
  2. Users must provide truthful and complete information during registration and promptly update it in the event of changes.
  3. Each user may create only one account and is responsible for the security of their account.

4. Booking and Mediation

  1. Customers can book Escort Drivers for heavy transport escort services via the app.
  2. Booking a service constitutes a contract between the Customer and the Escort Driver. The Operator of the app is not a party to this contract.
  3. Escort Drivers commit to providing the services described in the app.
  4. Users are obligated to keep their access data secure and not share it with third parties.
  5. The Operator reserves the right to suspend or delete user accounts in case of violations of these GTC or legal regulations.

5. Payment Processing & In-App Purchases

  1. Individual Trip Payments (Stripe): Payments for specific, individual escort services are processed securely via Stripe. By choosing this payment method, you agree to Stripe's Terms of Service and Privacy Policy. The Operator does not store your credit card details; they are handled directly by the payment provider.
  2. Apple Pay & In-App Store Billing: For digital products, such as trip packages (25, 50, 100 trips) and subscriptions, our app uses Apple App Store Billing. Your payment information is encrypted and processed directly by Apple. Your use of these services is subject to Apple's terms and conditions.
  3. Google Play Billing: For Android users, all digital packages and subscriptions are processed via the Google Play Store billing system.
  4. After transmitting the contact details for physical services, the Operator is no longer responsible for payments between the parties unless processed through the integrated platform tools.

6. Usage Fees and Commissions

  1. The Operator charges a mediation commission or other fees for using the platform, which are transparently displayed before a contract is concluded.
  2. The Operator reserves the right to change the fee structure with reasonable notice.

7. Rights and Obligations of Users

  1. Users are obligated to use the app only in compliance with applicable laws and these GTC.
  2. It is prohibited to post content that violates applicable law, third-party rights, or good morals.

8. Liability

  1. The Operator is not liable for damages arising from the use of the platform unless such damages result from willful misconduct or gross negligence on the part of the Operator.
  2. The Operator assumes no liability for the services provided by Escort Drivers or the fulfillment of contracts between Customers and Escort Drivers.

9. Subscriptions & Cancellation

  1. Auto-Renewal: Subscriptions (e.g., "Unlimited Monthly") are billed on a recurring monthly basis. Payment will be charged to your Apple ID or Google Account at confirmation of purchase.
  2. Cancellation: The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions in your App Store or Google Play account settings.
  3. Refunds: All refund requests for in-app purchases are handled directly by Apple or Google in accordance with their respective refund policies.
